Terms of Service

These Terms of Service ("Terms") govern your use of AscendOS and the ascendos-website.vercel.app website operated by Fresh Start Fitness ("we," "our," or "us"). By using our services, you agree to these Terms.

1. Acceptance

By downloading, installing, or using AscendOS you agree to these Terms. If you do not agree, do not use the app or website.

2. Description of Service

AscendOS is a 120-day personal development and life operating system app covering identity, performance, and lifestyle improvement. The service includes a free tier and a premium tier. Premium features are unlocked via license key after payment through PayPal.

3. User Accounts and License Keys

• License keys are issued one per paying customer and are non-transferable
• You may not share, sell, or redistribute your license key
• Misuse of license keys may result in revocation without refund

4. Payments and Refunds

• Payments are processed via PayPal. By completing payment you agree to PayPal's terms.
• Annual plans: $149.99/year. Monthly plans: $24.99/month.
• We offer a 7-day refund for annual plans if you have not received your license key or the app does not function as described. Email us within 7 days of purchase.
• No refunds are issued for monthly plans after the billing cycle begins.
• Founding member pricing ($149.99/year) is valid through March 31, 2026 and subject to change after that date.

5. APEX AI Coach

• APEX is a coaching tool, not a licensed therapist, counselor, or medical professional.
• APEX responses are AI-generated and may be inaccurate. Use your own judgment.
• If you are in crisis, experiencing thoughts of self-harm, or need mental health support, contact the 988 Suicide & Crisis Lifeline (call or text 988) or emergency services.
• Free tier: APEX requires a personal Anthropic API key (bring your own). Premium tier: up to 300 managed messages per month included.

6. Community Posts

• You may post wins and progress updates in the Community feed.
• You agree not to post illegal content, personal attacks, spam, URLs, or off-topic content.
• We reserve the right to remove posts that violate these guidelines.
• Posts are public to all app users and expire after 30 days.

7. Prohibited Use

You agree not to:

• Reverse-engineer, decompile, or extract the app's source code
• Use automated scripts to access the API endpoints
• Attempt to circumvent usage quotas or authentication
• Use the service for any unlawful purpose

8. Intellectual Property

All content, curriculum, branding, and code in AscendOS is owned by Fresh Start Fitness. You receive a limited, non-exclusive, non-transferable license to use the app for personal development purposes only.

9. Disclaimer of Warranties

AscendOS is provided "as is" without warranty of any kind. We do not guarantee specific results from using the program. Individual results vary based on effort, consistency, and personal circumstances.

10. Limitation of Liability

To the fullest extent permitted by law, Fresh Start Fitness shall not be liable for any indirect, incidental, or consequential damages arising from use of the service.

11. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the service after changes constitutes acceptance.
